HC to take up death penalty case (Odisha)

Cuttack: Orissa High Court has laid the groundwork for a hearing on capital punishment while fixing Monday to take up a case of death penalty.

The case concerns nine persons whom the additional district and sessions judge, Gunupur, had awarded capital punishment on April 14, for killing three of a family on the suspicion of being witches. No death sentence imposed by a trial court can be executed unless the punishment is confirmed by the high court. Hence, trial courts refer every judgment related to capital punishment to the high court.

Therefore, even when the convicts do not prefer an appeal, the trial court's verdict against them are automatically taken up by the high court registry as a referred trial and listed before a division bench for hearing. If the convict also prefers an appeal, then both the appeal as well as the referred trial is clubbed and heard together. In this case, the convicts had filed an appeal.

The division bench of Indrajit Mahanty and Justice Biswajit Mohanty had completed the groundwork with a preliminary hearing, getting the trial court records submitted in the high court on July 3 and fixing July 9 to start hearing on the death penalty. The high court will decide whether it was a "rarest of the rare" case and fit for capital punishment by assessing the prosecution's case.

According to the prosecution, the convicts had branded Asin Sabara, his wife Ambai Sabara and elder daughter Asimani Sabara of Kitum village as witches and held them responsible for death of children in their village. Accusing them of practicing sorcery, they dragged them out of their house and took to a cowshed where they were mercilessly beaten up. As the victims fell unconscious, the villagers had injected them with pesticides in their sensitive parts - such as eyes and private parts - and buried them alive on September 9, 2016.

When they came to know that somebody had tipped off the police about the crime, the accused persons had then exhumed the bodies and set them on fire on the same night. The convicts underwent trial under Section 302 (murder) of Indian Penal Code and the Odisha Prevention of Witch-Hunting Act, 2013. The convicts are Degunu Sabara, Dasantu Sabara, Dalasa Sabara, Ajanta Sabara, Podantu Sabara, Iru Sabara, Lakia Sabara, Bubuna Sabara and Maliku Sabara.

Nine get death sentence for killing 3 on suspicion of ‘sorcery’ (Odisha)

The accused allegedly exhumed the dead bodies and burnt them in an attempt to destroy evidence after the police were informed. 

The Gunupur District Court on Friday sentenced nine people to death for brutally murdering three members of a family in 2016 after suspecting they were practising sorcery. The murders in September last year in Rayagada district reportedly involved severe beating, injection of chemicals in the victims’ eyes and private parts, following which they were buried alive. The accused allegedly exhumed the dead bodies and burnt them in an attempt to destroy evidence after the police were informed. 

The deceased included a couple and their eldest daughter. The younger daughter, who had witnessed the crime, was threatened to not speak up. Around seven days after the incident, the survivor, locked up in the house of one of the accused, escaped and lodged an FIR. “I am glad they have received death by hanging,” said witness Melita Sabara, who is also with the Rayagada District Child Protection Unit. “The nine accused have been sentenced to death by hanging by Additional District Judge Subhendu Kumar Pati,” said Additional Public Prosecutor Krushna Chandra Senapati.

“The sentence has to be confirmed by the (Odisha) HC,” said the counsel for the accused. The family was held responsible for ‘witchcraft’ that allegedly killed many children in their native village of Kitum.

Three members of a tribal family, including two women, were hacked and then burnt.

A court in Odisha's Rayagada district on Friday sentenced nine persons to death for murdering three of a family in 2016 on suspicion of practicing sorcery. The Additional District Judge (ADJ) Court pronounced the sentence. 

In September 2016, the three members of a tribal family, including two women, were hacked and then burnt by some persons in Rayagada's Kitunga village. The convicts have been identified as Ajanta Sabara, Bubhuna Sabara, Maluku Sabara, Podantu Sabara, Iru Sabara, Lakia Sabara, Degun Sabara, Dasanta Sabara and Dalsa Sabara.

"Adjudicating the murder case, ADJ Subhendu Kumar Pati awarded death sentence to nine men," said Krushna Chandra Senapati, Assistant Public Prosecutor. The court earlier held 10 persons, including a minor, guilty in the case. The convicts' counsel said they will move the High Court.
