Ram Prasad Sahu, who had earlier served jail term in another case, was held guilty under section 302 of the Indian Penal Code for brutally killing his younger brother, Moti, in front of a huge mob on February 23, 2017.

A 42-year-old man has been awarded death sentence by a local court for killing his disabled younger brother.  The court of additional district and session judge, Jaipur metropolitan no. 14, awarded death penalty to Ram Prasad Sahu on Monday. Mr Sahu, who had earlier served jail term in another case, was held guilty under section 302 of the Indian Penal Code for brutally killing his younger brother, Moti, in front of a huge mob on February 23, 2017.

"The judge observed that there is no chance of improvement in his conduct and he is a threat to the society," public prosecutor Alok Sharma said. The incident had occurred in Bhatta Basti area of the city. Mr Sharma said that the man had placed his foot over the body and smoked a bidi next to it. Mr Sahu has served 14-year imprisonment in another case earlier. Besides, six other cases are also pending against him.

Judge pens emotional poem while sentencing man to death for raping 3-year-old (Rajasthan)

The trial started after a chargesheet was filed by the Jhunjhunu police on August 13 with the accused Vinod Kumar being convicted on August 30. The accused was awarded the death sentence on Friday, within 29 days of the crime. 

A judge in Jhunjhunu district of Rajasthan has penned an emotional poem while awarding death sentence to a man for raping a three-year-old girl on August 2. The 22-year-old accused was sentenced to death Friday by a POCSO court in Jhunjhunu under Section 376AB of IPC which was introduced under The Criminal Law Amendment Act, 2018 last month and has a provision for death sentence for the rape of girls below 12 years of age. The trial started after a chargesheet was filed by the Jhunjhunu police on August 13 with the accused Vinod Kumar being convicted on August 30. The accused was awarded the death sentence on Friday, within 29 days of the crime.

“Jis masoom ko dekh ke man me pyar umad ke ata hai, dekha usi ko man me kuch ke haivan utar ke ata hai (A child whose sight evokes love in the heart, some think of evil while gazing at her),” reads a part of the poem written by Judge Neerja Dadhich. In the poem, Dadhich has also criticised those who believe that rapes are linked to attire. “Kapdo ke karan hote rape jo kahe unhe batlau mai, akhir teen sal ki bacchi ko saree kaise pehnau mai (Those who say rapes happen because of clothes, I want to ask them how do I make a three-year-old chid wear a saree),” reads the poem. In her poem, Dadhich also said: “Gar ab bhi na sudhre to ek din aisa ayega, is desh ko beti dene se bhagwan bhi ghabraega (If we don’t change now there will come a day when even God will be afraid to bless this country with girls).”

According to the prosecution, Kumar had raped the victim at the residence of her maternal grandmother. “Our argument was that due to the heinous nature of the crime, this case qualified to be categorised as rarest of rare and the accused be given death penalty,” said Lokendra Singh Shekhawat, special public prosecutor.

Man sentenced to death for raping 3-yr-old (Rajasthan)

JAIPUR: Father of an infant girl was awarded the death sentence by the Jhunjhunu POCSO (Protection of Children from Sexual Offences) Court in Rajasthan on Friday for raping a minor on August 2. 

This is the fourth case in the state where the accused under POCSO were handed out death sentence. Nand Kishore, Special Public Prosecutor, POCSO Court, said this is the first case when the death sentence has been given to a rapist within 20 days of presenting the charge-sheet in a court. Accused Vinod Banjara, 23, is a resident of Dausa and used to sell utensils, Kishore said. On August 2, he raped the minor in a village when her maternal grandparents were away. The police formed a special team to investigate the case, Kishore said. "Through CCTVs, the accused was identified and arrested on August 3. 

He was remanded into custody where he confessed to the crime," he said. According to DGP Rajasthan, after death sentence was incorporated in the POCSO Act for the rape and killing of minors under 12 years, all police officers were directed to speedy investigation and filing of charge sheets in the court had expedited conviction. He said an accused in the rape of a six-year-old in Jhalawar on February 14 this year was handed out death sentence. He said the investigation was completed within 16 days and the court convicted for death on August 24 this year. Similarly, in another case where a six-month old baby was raped and killed at Laxmangarh in Alwar on May 10, the court awarded death sentence to the accused on July 21. In this case the charge sheet was filed within 26 days after the incident. 

An accused in a similar case reported at Barmer women’s police station was given death sentence on August 7 for raping a 12- year-old girl, he said.

Youth convicted of raping 7-month-old, first in Rajasthan under new law

The conviction comes within 70 days of the incident. Special Judge Jagendra Kumar Agarwal, of the SC/ ST Court in Alwar, took 12 hearings over 22 days.

IN THE first conviction in Rajasthan under the strict provisions of the Criminal Law (Amendment) Ordinance, 2018 — which awards death penalty to those convicted of raping girls under 12 years — a 19-year-old youth has been convicted of raping a seven-month-old girl. The conviction comes within 70 days of the incident. Special Judge Jagendra Kumar Agarwal, of the SC/ ST Court in Alwar, took 12 hearings over 22 days. While the youth was convicted on Wednesday, the court is set to pronounce the sentence Saturday. Rajasthan DGP O P Galhotra confirmed that this is the first conviction in the state under the Criminal Law (Amendment) Ordinance, 2018. The Ordinance was brought in on April 21, in the wake of the outcry over the gangrape and murder of an eight-year-old Bakarwal girl in Kathua (J&K) and the alleged rape of a 17-year-old girl in Unnao (UP).

The Union Cabinet Wednesday approved the Criminal Law (Amendment) Bill, 2018, to be introduced in the monsoon session of Parliament, which will replace the Ordinance. Under the Bill, the punishment for raping girls under 12 years old is 20 years to life term with fine, or death penalty. The Alwar incident dates back to May 9, when the seven-month-old’s father had, in a complaint to the police, accused the youth, Pintu, of raping the child. He said the baby had been left in the care of a blind relative. “When I returned home in the evening, only my relative was there …She told me that our neighbour, Pintu, had taken my daughter away half-an-hour ago, and hadn’t returned,” he said in the complaint. “The child was found crying in a football field, about a kilometre away from our home. Pintu had raped her and she was bleeding,” he said. 

Pintu was caught within hours, and a case was lodged under IPC Sections 363 (kidnapping), 366A (procuration of minor girl) and relevant sections of the POCSO Act at Laxmangarh police station in Alwar. The child’s medical report confirmed rape, and the accused also confessed to his crime, said officials. The police investigation was completed in 27 days and a challan was filed in the court under IPC Sections 363, 366A, 376AB, 376 (2), as well as sections of the POCSO Act. Section 376AB was introduced in the Ordinance and deals with punishment for rape of child under 12 years. On March 9, the Rajasthan Assembly passed a Bill to provide for death penalty for raping a girl child below 12 years . The Bill is currently pending with Centre.

Rajasthan passes bill for death penalty for rape of girls aged 12 & below

Rajasthan becomes the second state to have such law after Madhya Pradesh. Crime in India, 2016 revealed that 19,920 children were allegedly victims of child rape in 2016 alone.

Rajasthan on Friday approved a bill providing for the death penalty to those convicted of raping girls under 12 years of age. Madhya Pradesh has already cleared a bill with similar provisions in December last year while Haryana Cabinet this February gave its nod to a proposal to bring in such a legislation. Maharashtra and Karnataka are also considering the death penalty for child rapists. State Home Minister Gulab Chand Kataria introduced The Criminal Laws (Rajasthan Amendment) Bill, 2018 on Friday in the assembly, which was passed in the House by a voice vote following a debate. The bill seeks to add section 376-AA in the Indian Penal Code (IPC), which will be defined as: “Punishment for rape on a woman up to twelve years of age. Whoever commits rape on a woman up to twelve years of age shall be punished with death, or rigorous imprisonment for a term which shall not be less than fourteen years but which may extend to imprisonment for life which shall mean imprisonment for the remainder of that person’s natural life, and shall also be liable to fine.”

Two amendments were made in the bill including that the convict cannot leave the prison for life even after completing 14 years of sentence. “We have made two amendments in the case. Added life sentence & life imprisonment for convicts in offenses against girls below 12 years of age, also made a provision that convict can’t leave the prison for life even after completing 14 years of sentence,” said Rajasthan Home Minister G.C. Kataria. A similar provision, 376-DD, will be added for gangrape. In the ‘Statement of Objects and Reasons’ for bringing in the Bill, the government said, “It has come to the notice of the State Government that the offence relating to child rape and child gang-rape are taking place every now and then. Such crimes are heinous and turn the life of the victim into hell.”

Earlier in February, Chief Minister Vasundhara Raje, in a reply to the Budget debate in the Assembly, had announced that the state government will bring in more stringent punishment, “including capital punishment”, for rape of girls under 12 years. According to the National Crime Record Bureau (NCRB) 2016 report, the cases of crimes against children have shown a steady rise in Rajasthan. The state recorded 4,034 such cases in 2016, which is 3.8 per cent of the crimes against children (98,344) registered across the country. It stands fourth in the crime against women category. In 2015, the state had registered 3,689 cases of crime against children, which increased by 345 in the year under review. As per the NCRB data, state police registered 728 cases of child rape in 2015, which increased to 858 in 2016.

Man accused of kidnapping, killing 7-year-old sentenced to death (Rajasthan)

Kota: A man accused of kidnapping and murdering a seven-year-old child in 2014 has been sentenced to death by a Kota court.

The Special and Sessions Court gave Ankur Pandian capital punishment, and co-accused Anup Pandian a life sentence. Two other accused, Mahavir Sharma and Karanjit Singh, have been sentenced to four, and two years in prison, respectively. Rudraksha, the seven-year-old child of a bank employee and a school teacher, was abducted for a ransom of Rs 2 crore.

The accused said he committed the crime as he had lost money in cricket betting. DGP OP Gilhotra welcomed the verdict, and attributed it to the consistent work shown by the investigating officer, under the case officer scheme. The scheme ensures that a particular officer investigates a case from the beginning until the verdict, to ensure that the responsibility of conviction remains with him.

Kota: A special court today sentenced three persons to death for raping a 30-year-old woman and killing her along with her minor son during a robbery in December 2012.

The Schedule Caste and Schedule Tribe (SC/ST) special court here also imposed a fine of Rs 75,000 on each of the three convicts under various sections of IPC, Arms Act and SC/ST Act. The three were booked in December 2012 in Udhyognagar police station of the city on charges of robbery, gang rape and murder. Special SC/ST court judge Girish Kumar Agrawal convicted Kapil alias Anna, Imran alias Dillhi Wala, both residents of Udhyognagar area of Kota city, and Tipu alias Sultan alias Aabeed of Tonk district, Special Public Prosecutor (SPP) Kamal Kant Sharma said here.

They were awarded death penalty under IPC sections 302 (murder) and 34 (common intention), the SPP said. The three convicts are about 22 to 25 years old, he added. The court also sentenced the three to 10 years imprisonment and imposed a fine of Rs 20,000 on each of them for rape. They were also handed down seven years imprisonment under IPC section 397 (robbery or dacoity, with attempt to cause death or grievous hurt), the SPP said.

The three were also sentenced to life imprisonment and slapped with a fine of Rs 20,000 under SC/ST Act. It was alleged that the three men broke into the house of Shiva Koli at night and looted jewellery, cash and other items. They gang raped Shiva's wife who was sleeping with her minor son in the room, the special public prosecutor said. The three convicts then shot the woman and her son and escaped after placing the minor son’s body ina box, he added. Udhyognagar police had on December 6, 2012 lodged a case in this connection under various sections of IPC, SC/ST Act and Arms Act, and following the investigation, arrested the three who are still in jail as they were not granted the bail. A total 35 witnesses were produced and 130 documents were submitted to the court during the trial, the SPP added.
