CUTTACK: Setting aside death penalty awarded by a district court, the Orissa High Court acquitted a tantrik of Jajpur district who was charged with human sacrifice of an eight-year-old boy five years back. Justice Vinod Prasad and Justice Raghubir Dash yesterday quashed Jajpur the district session court s death sentence and upheld the appeal of the 'tantrik' Pitambar Goipoi of innocence setting him free of murder and other related charges.

The bench annulled the lower court's verdict on the ground there was lack of clinching evidence in the case. District judge Jivan Ballav had in August this year convicted the tantrik of abduction and murder of infant Srikant Bag and sentenced him to death. Sukinda police had retrieved the beheaded body of Srikant from a deserted place in Damodarpur village on February 13, 2010, two days after he went missing. Police subsequently recovered the infant s head along with some puja materials from a deserted place near the tantrik s house. On a complaint from the boy s relative that the tantrik had sacrificed the boy to propitiate the local deity and public outrage, police arrested him. While the 'tantric' could not defend the case.

District and sessions judge Jivan Ballav here today awarded death sentence to 30-year-old tantrik Pitambar Gaipei for sacrificing eight-year-old Srikant Bag in the district's Damodarpur village in 2010.

Jajpur, Aug. 4: District and sessions judge Jivan Ballav here today awarded death sentence to 30-year-old tantrik Pitambar Gaipei for sacrificing eight-year-old Srikant Bag in the district's Damodarpur village in 2010. The murder came to light after police had found Srikant's beheaded body from a nullah at Icchanagarpatana, a village near Damodarpur, on February 13, two day's after he went missing. The child's head was found buried near the tantrik's house along with some religious offerings. Pitambar, a resident of Icchanagarpatana village, had slit the child's throat and pierced the body with a sharp weapon.

He had sacrificed the boy to propitiate gods to bring good fortune to the area, he had subsequently confessed to the police. According to court records, on the night of February 11, 2010, Srikanta had accompanied his father to Icchanagarpatana village to witness an opera. The accused had lured the child by offering him chocolates when he had stepped out alone to answer nature's call during the opera show. He later took the child to his house and killed him before the idols the same night. After failing to trace him, the boy's father Ram Bagi had lodged a complaint with the local police the next day.

After it found Srikant's headless body on February 13, the police raided Pitambar's house and recovered the boy's severed head. But the tantrik had managed to escape. Following a hue and cry, the police nabbed him on February 18. The court had examined 22 witnesses before delivering the judgment today. Public prosecutor Kishore Kumar Kar said the accused deserved capital punishment. "This was a heinous crime. The accused had killed a minor boy in cold blood out of blind (superstitious) belief," he said.
