SC Commutes Death Penalty, Sentences Child Rapist To 25 Years Without Remission (Madhya Pradesh)

The Supreme Court on Tuesday commuted the death sentence of a man held guilty of committing rape of a five-year-old girl and then killing her in 2015 in the Satna district of Madhya Pradesh. The apex court has sentenced the man to 25 years in jail without remission.

Earlier, the trial court had sentenced Sachin Kumar Singhraha to death, which was upheld by the Madhya Pradesh High Court. Challenging the orders, counsel for the Singhraha had contended that he was sentenced on the basis of circumstantial evidence and the police had failed to establish his guilt beyond doubt. He said the lower courts had not followed SC framed guidelines while awarding the death penalty.

In 2016, a bench headed by then CJI T S Thakur had stayed the death sentence.

Rape And Murder Of Minor Daughter: MP HC Commutes Death Sentence To Life Imprisonment (Madhya Pradesh)

The Madhya Pradesh High Court has commuted a death sentence to life imprisonment of a man (Mehet Lal) convicted in rape and murder of his minor daughter for his case do not fall in rarest or rare category. According to the court mitigating facts and circumstances in the case show the man sentenced to gallows is not a hardcore criminal or threat /menace to the society or antisocial element and have no criminal antecedent. In addition the court found the prosecution has failed to prove that the appellant is incapable of being reformed and he is father of prosecutrix so there is every probability that he can be reformed and rehabilitated. There is a global move to abolish death sentence where 138 countries have abolished death sentence while 59 countries including India have no criminal antecedent. 

The appellant fulfils all four objectives which State intends to achieve namely deterrence, retribution, prevention and reformation can be achieved by keeping the appellant alive. A division bench of Justice S K Gangele and Justice H P Singh said “he is liable to be punished severely but it is not a case which falls within a category of rarest of rare cases”. “The balance sheet of aggravating and mitigating circumstances has to be drawn up and in doing so, the mitigating circumstances have to be accorded full weightage and a just balance has to be struck between the aggravating and mitigating circumstances before option is exercised”, the court held. The court observed the judicial approach towards sentencing “has to be more cautious, circumspect and careful". The court disposed of the appeal and the reference.

Death sentence for man convicted for murderous acid attack

The Gwalior bench of Madhya Pradesh High Court has upheld the capital punishment awarded to a man by the sessions court for causing a woman’s death by throwing acid on her. The High Court on Friday dismissed the appeal filed by Yogendra Tomar against the verdict of additional sessions judge.

Assistant public prosecutor Ramniwas Tomar said that Yogendra threw acid on the woman, Ruby, on July 21, 2013 after forcing entry into her house in Morena town. Some acid also fell on her mother and brother, injuring them. In her dying declaration, Ruby told the police that Yogendra wanted to have an intimate relationship with her and she had spurned him.

Yogendra, a married man, was allegedly involved in a murder earlier too, according to the prosecution. On July 24 this year, additional sessions judge P C Gupta awarded death sentence to Yogendra. The division bench of Justices S K Gangale and Rohit Arya on Friday upheld the lower court’s verdict.
